This agreement is between Rose City Photo Co. (“the Studio”) and the client(s) named on the proposal and payment record (“the Couple”). By checking the acceptance box and paying the retainer or full balance through this website, the Couple agrees to the terms below for the collection and add-ons selected on their proposal page.
The Studio will provide wedding photography coverage, the Rose City photo booth, and any selected add-ons as described in the Couple’s proposal at the time of booking. The itemized selection, hours of coverage, and pricing recorded with the payment constitute the scope of this agreement.
A retainer of 50% of the collection total (or payment in full, where that option is selected) reserves the wedding date. The retainer is applied to the total balance. Any remaining balance is due 14 days before the wedding date. Discounts recorded at the time of payment are honored as shown on the payment record.
The retainer is non-refundable, as it reserves the date and turns away other bookings. If the Couple cancels more than 90 days before the wedding, no further balance is owed. If the Couple cancels within 90 days of the wedding, half of the remaining balance is owed. If the Couple reschedules and the Studio is available on the new date, the retainer transfers once at no charge.
The Studio operates with a team of professional photographers. The Couple’s wedding will be photographed by a lead photographer assigned by the Studio. In case of illness, emergency, or other circumstance, the Studio may substitute a comparably skilled photographer, and this substitution does not constitute a breach of this agreement. All images are edited to the Studio’s published standard regardless of the photographer.
A preview selection is delivered within approximately 24 hours, and the full curated gallery within approximately 1–2 weeks of the wedding. Delivery timelines are good-faith estimates, not guarantees.
The Studio retains copyright in all images. The Couple receives a personal, non-commercial print release: they may download, share, and print their images at their discretion. The Couple may not sell images or license them commercially without written permission.
The Studio may use images from the wedding for its portfolio, website, social media, and marketing. If the Couple prefers their images stay private, they may opt out by written notice before the wedding, and the Studio will honor it.
The Studio maintains a 3-2-1 archive of every wedding as described on its archive methodology page. The archive is maintained as a courtesy and best practice; the Couple is encouraged to keep their own backups of delivered images.
The Studio’s ability to capture specific moments depends on conditions beyond its control (weather, venue rules, timeline changes, guest interference, officiant restrictions). The Studio will always exercise professional judgment to capture the day as fully as conditions allow. For coverage of 8 hours or more, the Couple agrees to provide the photography team a meal and a short break.
In the unlikely event of a failure to perform caused by circumstances within the Studio’s control, liability is limited to a refund of all payments made under this agreement. In cases of loss or damage of images beyond the Studio’s control, liability is limited to a proportional refund reflecting the images affected. The Studio carries no liability for consequential or emotional damages.
This agreement is governed by the laws of the State of Oregon. Any dispute will first be addressed in good faith between the parties before any other remedy is pursued.
